The following Terms and Conditions are set out for use of https://blogwithjags.mn.co, the mobile application(s) and any features, subdomains, content (except as specified hereunder), functionality, products, services, media, applications, or solutions offered on or through the Site and/or the Application and/or through any modes, medium, platform or format (hereinafter collectively referred to as the “Platform”/ “RankwithJags Platform”).

These Terms and Conditions shall apply to all users of the Platform, including without limitation, all persons who create and / or make available Content on the Platform and users who access the Platform to learn the skill, referred to as “Learners” or users who access the Platform otherwise (collectively referred to as “you”, “your”, or “User(s)”). These Terms and Conditions shall be collectively referred to as the “Platform Term(s)”, defines the relationship between the User and RankwithJags, and they shall govern their use of the Platform and the Services offered therein. The user’s access to the Platform is subject to the user’s acceptance of the Platform Terms and such acceptance of the Platform Terms forms a legally binding agreement between the user(s) and RankwithJags. Hence, the user(s) is requested to please take their time to read the Platform Terms in their entirety.

From time-to-time, updated versions of the Platform Terms may be made available as aforesaid for the user(s)’s reference. By visiting and accessing the Platform, providing the Personal Information, using the Services offered or by otherwise signalling an agreement when the option is presented to the user(s), the user(s) hereby expressly accept and agree to the Platform Terms. If the user(s) does not agree to any of the terms or does not wish to be bound by them, then the user(s) is not to use the Platform in any manner.

ABOUT ‘RANKWITHJAGS’

RWJ aka RANKWITHJAGS is our passion project, our give back to this beautiful Search Engine Optimisation (SEO) community, which has given us- more than we could imagine. To come up with a sustainable, systematic resource to help bloggers who aspire to learn ranking on google but cannot find a credible resource to do so. Proudly so, called GOOGLE DOMINATION.

A little backstory- It was on 12th of April, 2022- when I put up a story for hiring an intern and got flooded with 140 requests but could not find one applicant with the right fundamentals- I thought to myself, it’s time I design a module to teach GOOGLE DOMINATION and bust the myth- that it is complicated or technical. It’s just like physics & boy- do I love physics.

Why is SEO so important?

SEO is something every founder knows or should know about but the hard truth is not everyone does, in-fact IT IS RARE. If you want to survive in this generation, where brands are taking the driver’s seat- brand profiling or SEO is the most under-rated but wisest skill to hold. It’s not about keyword rankings and link building. It’s about solving your pain points, showcasing your brand technically & figuratively to help you grow. This is the bridge we have built over the years for ourselves, our clients and now for our students.

PLATFORM SERVICES:

RankwithJags Platform is an online service platform enabling bloggers who aspire to learn ranking on google but cannot find a credible resource to do so. We offer our training, personal mentorship, high action calls, accountability calls, one to one help and niche research services. RankwithJags may also offer, either directly or indirectly (through other third party platforms), other incidental and ancillary services.

Further, RankwithJags may offer certain products/services to the user(s) in collaboration with one or more of the RankwithJags Group Platforms. In such cases, to the extent that such product/services are made available to the user(s) through the Platform, the Platform Terms shall continue to apply to the user(s).

For the purpose of the Platform Terms, usage of the terms “Platform Services”/ “Services” shall mean and include all the services referred to in this section and such other products or services as may be offered by RankwithJags.

The user(s) agrees and acknowledges that RankwithJags shall have the right at any time to change or discontinue any Service, product, aspect, or feature of the Platform. RankwithJags reserves the right to terminate the Subscription and / or restrict access to the Platform, if the user(s) chooses not to provide / partially provide the requested information.

RIGHT TO ACCESS AND ACCOUNT CREATION

As a Learner, to access the Platform and use certain Services, the user(s) will be required to register and create an account on the Platform by providing the requested details such as Name, e-mail address, Mobile number etc.

The user(s) can register on the Platform by requesting to join for free however, the user(s) will be required to answer certain questions and the registration will be confirmed only after approval has been granted.

Further, the permission given by RankwithJags to access and use the Platform under these Terms and Conditions is subject to the following conditions:

We disclaim any guarantee or responsibility for the outcomes or results arising from participation in the course.
The course is conducted in English, utilising basic English language proficiency.
The user(s) agrees not to distribute in any medium any part of the Platform or the Contents without the prior written authorisation by RankwithJags.
The user(s) agrees not to alter or modify or re-brand any part of the Platform.
The user(s) agrees not to use the Platform for any of the following commercial uses unless they obtains the prior written approval by RankwithJags’:
1. the sale of access to the Platform;
2. the sale of advertising, sponsorships, or promotions placed on or within the Platform or its Content; or
3. the sale of advertising, sponsorships, or promotions of any third-party page or website.
The user(s) agrees to receive installs and updates from time to time from RankwithJags. These updates are designed to improve, enhance, and further develop the Platform and may take the form of bug fixes, enhanced functions, new software modules and completely new versions. The user(s) agrees to receive such updates (and permit RankwithJags to deliver these) as part of the use of the Platform.
The user(s) hereby agrees not to employ or initiate any automated system, which includes but is not limited to, “robots,” “spiders,” or “offline readers,” to access the Platform in a manner that generates a greater volume of request messages to RankwithJags’ servers within a specified timeframe than what a human could reasonably produce using a typical online web browser during the same duration. However, notwithstanding the aforementioned restriction, RankwithJags permits operators of public search engines to utilise spiders for the sole purpose of copying materials from the Site, exclusively to the extent necessary for creating publicly accessible searchable indices of said materials, excluding caches or archives thereof. RankwithJags retains the right to revoke these permissions, either universally or in specific instances, at any time, with or without prior notice. The user(s) also agrees not to gather or extract any personally identifiable information, including account names, from the Platform, nor to utilise the communication systems provided by the Platform, unless expressly permitted elsewhere in these terms.
The user(s) may post reviews, comments and other content; send other communications; and submit suggestions, ideas, comments, questions or other information as long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringement of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any other form of spam, harassment, abuse or distress to the partners or mentors of the platform. In other words, the user(s) shall ensure that their conduct on the Platform is in accordance with the Platform Terms, including the User Guidelines.
While using the Platform, the user(s) will, at all times, comply with all applicable laws and regulations.
RankwithJags reserves the right to discontinue any aspect of the Platform at any time with or without notice at its sole discretion.

The user(s) is responsible for maintaining the confidentiality of their account and password to access the Platform. The user(s) acknowledges that their account is personal to them and agree not to provide any other person with access to the Platform and to restrict access to their device to prevent any unauthorised access to their account. The user(s) agrees to accept responsibility for all activities that occur under their account. The user(s) should use particular caution when accessing their account from a public or shared computer so that others are not able to view or record their username, password, or other Personal Information. The user(s) should take all necessary steps to ensure that the password is kept confidential and secure at all times, and they have any reason to believe that their password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorized manner, the user(s) agrees to immediately change their password or inform us of any unauthorized access to or use of their username or password, so that we are able to help them stop or prevent such unauthorized access. The user(s) shall ensure that the details provided by them are correct and complete.

The user(s) represents that the information provided by them at the time of the registration are correct, true and accurate, and the user(s) agrees to update the same as and when there is any change in the said information.

Please note that we reserve the right to reject or put on-hold the user(s) registration on the Platform as may be required to comply with any legal and regulatory provisions, and also reserve the right to refuse access to the Platform, terminate accounts, remove content at any time without providing any notice to the user(s), and/or reserve the right to disable any account, feature, or identifiers, whether chosen by the user(s) or provided by us, at any time if, in our opinion, the said identifiers or the user(s) have violated any provision of the Platform Terms.

Further, to access the Platform, create, publish and/or view the User-generated Content on the Platform, the user(s) will need to use a “Supported/Compatible Device” which means a personal computer, mobile phone, portable media player, or other electronic device that meets the system and compatibility requirements and on which the user(s) is authorized to operate the Platform along with a static IP address (the cost of the IP is to be paid and borne by the user/student). The Supported/Compatible Devices to access the Platform and/or avail the Services may change from time to time and, in some cases, whether a device is (or remains) a Supported/Compatible Device may depend on software or systems provided or maintained by the device manufacturer or other third parties. Accordingly, devices that are Supported/Compatible Devices at one time may cease to be Supported/Compatible Devices in the future. Thus, kindly make sure that the device that the user(s) is using is compatible with our system/software to use the Platform and avail the Services offered therein.

SUBSCRIPTION TERMS

The terms that are applicable to the user(s) for purchase of the Course(s) are –

Purchase of the course(s) will allow the user(s) access only to the content available under the category of content for which the user(s) has purchased the course(s).
The Services offered, and the validity/term of the Course(s) may vary depending on the Course(s) the user(s) may purchase. Hence, before proceeding to purchase any Course(s), the user(s) is suggested to read and understand the details of the Course(s) the user(s) intends to purchase on the Platform. If the user(s) is unclear about any part of the Course(s) offering or need further clarification, then the user(s) can feel free to write to us prior to the purchase at the email address provided in the ‘Contact for User Support/Queries’ section below.
All personal mentorship services shall remain valid for a period of 12 months from the date of purchase.
All specified niches shall remain relevant for a duration of 6 months from the date of delivery.
All personal mentorship calls shall have a duration of 15-30 minutes.
Personal mentorship, high-action, and accountability modules are applicable solely to a single project. Advice and guidance provided within these modules pertain exclusively to the designated project and cannot be transferred to or utilized for any other project under any circumstances.
We recommend seeking our assistance at the commencement or immediately following the initiation of the user(s) project. However, we do not guarantee the success or outcomes of the user(s) project.
Each individual is entitled to one personal mentorship call or high-action call. Rescheduling of subsequent calls is not permitted. Should assistance be required, individuals may contact the team for further support. While the team will endeavor to accommodate requests for calls, such accommodation cannot be guaranteed.
High-action calls will span a duration of 45 to 60 minutes, contingent upon the requirements of the website.
All accountability calls shall last for 15 minutes.
Accountability calls or modules cannot be rescheduled, cancelled, or delayed.
Accountability calls and high-action calls utilize a WhatsApp group for personal communication. We are not held liable for any resolutions or outcomes arising from interactions within the group. Official communication remains exclusively through email.
All provided knowledge is based on personal knowledge and experience. Practical implementation may not always yield desired results and is subject to individual implementation, alterations, and execution. Given the variable nature of Search Engine Optimization (SEO), there is a possibility of unfavorable perceptions by Google and we shall not be held responsible for the same.
Search Engine Optimization (SEO) practices undergo continual changes. It is advised to seek our guidance before implementing significant changes to the user(s) website. Once changes are made, we cannot reverse any resulting repercussions.
Google updates occur periodically, and users are advised to adapt accordingly.We shall not be liable for any loss occurred due to any updates by Google.

While we strive to provide the user(s) a high-quality viewing experience, we make no guarantee as to the resolution or quality of the content the user(s) will see when streaming.

PRICING, PAYMENTS AND REFUNDS

Pricing and Payments: The user(s) can purchase any Course(s) or Service of their choice for any category(ies) of content by following instructions on the Platform and making the payment applicable for the Course(s) or Service the user(s) intend to purchase.

Please read the below terms applicable for the purchase. The below terms are to be read with any other terms communicated to the user(s) at the time of purchase of the Course(s):

The user(s) agrees to pay all fees and charges that are attributable to the account on the Platform and that the user(s) is solely responsible for payment of these fees and charges. The fees and charges are payable in full and in advance and are valid until the completion of the applicable Period or until otherwise cancelled or terminated in accordance with the terms of this Agreement.
If the user(s) has specifically authorized us, then the payments for the applicable Subscriptions are automatically charged at the beginning of each billing period, unless the user(s) withdraws the authorization or submit a cancellation request to us directly through their account prior to the start of the billing period or in writing via email to the address specified in the ‘Contact for User Support/Queries’ section below. Subject to the specific authorization and applicable laws, the user(s) agrees that RankwithJags may charge any recurring service to the credit card or debit card or account that the user(s) provide/link at the time of their first purchase or as updated by the user(s) through the account on the Platform, provided such updation takes place prior to upcoming billing period.
If the user(s) has not completed the payments, we may restrict / suspend access to the Platform until the user(s) account becomes current and paid in full.
We reserve the right to pursue the fee owed to us using collection methods which may include charging other payment methods on file with us and/or retaining collection agencies or legal counsel.
The user(s) payments to RankwithJags shall be subject to applicable taxes including without limitation Goods and Service Taxes (GST) and Value Added Taxes (VAT) or other similar taxes as may be applicable in their country of residence/from where the user(s) has created the account on the Platform/ purchased the underlying Course(s).
We reserve the right to change/revise the pricing of the Course(s).
We further reserve the right to offer custom plans and pricing (including discounts and / or special offers) in addition to what is offered on the Platform, which include offering custom billing and payment terms, that are different from our standard terms.
We may use third-party payment gateways and/or aggregators to process payments applicable to the Services offered by us. Third-party payment gateway(s) made available to the user(s) may vary depending on the Course(s) chosen by them. Similarly, we have also enabled integration of third-party payment providers to facilitate better payment options to the user(s), which may vary depending on the user(s)’s territory or the Course(s) chosen by the user(s). Third-party payment gateways/aggregators and third- party payment providers shall collectively be referred to as “Third-Party Service Providers”.

Third-Party Service Providers may also charge the user(s) fees to use or access their services and may require their Personal Information to complete any transaction for the Platform. Further, to facilitate completion of the payments to us through the Platform or avail the payment options provided to the user(s), the user(s) may be redirected to an external website operated by the Third-Party Service Provider. We cannot and do not

guarantee the adequacy of the privacy and security practices employed by or the content and media provided by the Third-Party Service Provider or its respective websites or
control collection or use of the Personal Information by such Third-Party Service Provider. Hence, prior to using any services offered by a Third-Party Service Provider, we suggest that the user(s) read their terms and conditions, privacy policy and other policies, that may apply, to understand their terms of usage and to understand how the Personal information is being processed. RankwithJags is not affiliated to any Third-Party Service Provider and neither RankwithJags nor any of the Third-Party Service Provider are agents or employees of the other.

Further, pursuant to the payment option the user(s) may choose, they may be required to enter into a separate agreement with the relevant Third-Party Service Provider. This agreement with the Third-Party Service Provider is an independent contract/agreement between the user(s) and such Third-Party Service Provider and RankwithJags shall in no manner be a party to the same. RankwithJags is only facilitating various payment options to the user(s) and is not offering the payment by itself in any manner. RankwithJags expressly disclaims any responsibility and liability for all services provided by the Third-Party Service Provider(s).

Please note that all payments are collected by RankwithJags only through the Platform and not through any third parties (except Third-Party Service Provider(s)). We do not usually authorize any third party (except Third-Party Service Provider(s)) to collect monies on our behalf; however, if we have authorized any third party then such third party will have received a written authorization from RankwithJags either by way of any agreement or an authorization letter. Kindly verify with such third party before making any payments to them, alternatively, the user(s) can always check with us by writing to us at email address provided under the ‘Contact for User Support/Queries’ section below.
Further, RankwithJags is solely authorized to offer discounts / offers, if any, on the Course(s) prices. These discounts / offers are communicated on the Platform or via direct communication to the user(s) from RankwithJags via email, SMS, phone, or such other means of communication, and can be availed only through the Platform, unless otherwise specifically communicated by RankwithJags. Other than RankwithJags, no person, including without limitation, Content Providers or any third-party platform, are allowed to offer any discounts on the prices offered on the Platform. RankwithJags shall not be liable for any claims arising from such unauthorized discounts / offers offered by any person (including any third- party platform or Content Provider), other than RankwithJags.

CANCELLATION AND REFUND POLICY:

The user(s) may cancel the Subscription through their account on the Platform. However, there shall be no refund of the fee already paid for the same under any circumstances whatsoever.

When the user(s) cancels the Subscription, RankwithJags may disable access to features made available to them upon their purchase of Subscription, while their account may continue to exist on the Platform.

USE OF THE PLATFORM

Subject to the Platform Terms, RankwithJags hereby grants the user(s) a non- exclusive, non-transferable, non-sub licensable, limited license to access and use the RankwithJags Platform for their own personal, non-commercial and private use on an ‘as is’ basis in accordance with these Terms and Conditions and other Platform Terms.

We may automatically remove the access to the content from their Compatible Device after the end of the Subscription Period or in accordance with any restriction mentioned in the Platform Terms.

COMMUNICATIONS

When the user(s) visits the Platform, the user(s) is communicating with us electronically. The user(s) may be required to provide a valid phone number while creating any account with us or while enrolling or purchasing any Subscription Service. We may communicate with the user(s) by e- mail, SMS, phone call, WhatsApp or by posting notices on the Platform or by any other mode of communication.

By providing the information the user(s) authorizes RankwithJags, its affiliates, and their respective employees, agents, and contractors to initiate electronic communications by email, telephone calls, WhatsApp or such other mode of communication with respect to their use of the Platform and regarding the products and services offered by RankwithJags and its affiliates. These communications may be made by or on behalf of RankwithJags, even if the user(s)’s phone number is registered on any state or federal do not call list.

Telephone calls may be recorded. The user(s) acknowledges that their telephone operator and/or internet service provider may have levied certain charges on them vis-à-vis their communications with RankwithJags as it constitutes availing their services, and they agree to be responsible for all such charges, and RankwithJags will not be responsible for any such charges.We recommend the user(s) to not submit their information if they do not consent to being contacted by telephone, text, email, WhatsApp or such other mode of communication. Further, the user(s) will always have an option to unsubscribe / opt out from any promotional communications sent by RankwithJags and / or its affiliates either by following the relevant instructions that may be communicated via text, email or such other mode of communication in which the user(s) received a promotional communication or by disabling the options provided within their account on the Platform.

Please note that –

If the user(s) opts out of promotional communications, we may still send them transactional communications, such as service announcements, administrative and legal notices, and information about the account, without offering them the opportunity to opt out of these communications. If the user(s) no longer wish to use our Platform or receive any communications from us (except for those that are legally required), then they may delete their account by either writing to us at the email address provided under ‘Contact for User Support/Queries Section below by using the option enabled within the Platform; and
We do not sell any Personal Information to third parties.

INTELLECTUAL PROPERTY AND LICENSE

RankwithJags and / or its affiliates own all information and materials (in whatever form or media) provided or communicated to the user(s) by or on behalf of RankwithJags including but not limited to, the Platform, illustrations, letters, images, ideas, concepts, the layout, design, flow, look and feel of the Platform, logos, marks, graphics, audio files, video files, any software which is owned by or licensed to RankwithJags and / or its affiliates, the underlying source and object code, instructions embedded in any form of digital documents and other data, information, or material made available to them by RankwithJags. RankwithJags Content, including its trademarks, will not be used, modified, or altered by the user(s) in any way. The user(s) acknowledges and agrees that they do not acquire any ownership or rights to the RankwithJags Content or the Platform by use of the Platform. The user(s) acknowledges and agrees that the RankwithJags Content is protected by the copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws and any unauthorize use, reproduction, modification, distribution, transmission, republication, display or performance of the RankwithJags Content and any component thereof is strictly prohibited.

Except as expressly permitted under any of the Platform Terms or otherwise in writing, the user(s) will not reproduce, duplicate, copy, sell, redistribute, create derivative works or otherwise exploit the Platform or any portion of the Platform (including but not limited to any copyrighted material, trademarks, or other proprietary information).

The user(s) confirms and undertakes not to utilize any data mining tools, robots, or similar data gathering and extraction tools to extract for re-utilization of any substantial parts of this Platform, without RankwithJags’s express prior written consent.

FEEDBACK

The user(s) understand and confirm that they shall not at any time post or publish any content, comments or act in any way which will amount to harassment of the partners, mentors of RankwithJags or any other User using any means whatsoever such as Social Media, Youtube or Personal comments. If at any given point it comes to RankwithJags notice that the user(s) has engaged in any kind of harassment, abuse or mental distress to any of the partners, mentors of RankwithJags or any other Users, then in such a case the user(s) agrees that RankwithJags shall have the sole right to suspend/terminate their account with immediate effect and without any notice of such suspension or termination and we also reserve the right in our sole discretion to initiate any legal proceedings against the user(s) in such cases.

If any User(s) submits suggestions, ideas, comments, or questions containing product feedback about the Platform or any of the Services, either through the Platform or otherwise, then such User(s) grants RankwithJags and its affiliates a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable right to use (and full right to sublicense), reproduce, modify, adapt, publish, translate, create derivative works from, distribute, transmit, and display such Feedback in any form. Users shall have no intellectual property right in the Platform as a result of RankwithJags’ incorporation of their Feedback in the Platform.

RANKWITHJAGS’ RIGHTS

In respect of the entire Platform, RankwithJags reserves the following rights:

RankwithJags reserves the right to put on-hold or reject or suspend or terminate the user(s) registration on the Platform for the purpose of complying with the legal and regulatory requirements.
RankwithJags may modify, terminate, or refuse to provide Services at any time for any reason, without notice.
Notwithstanding anything contrary stated in the Platform Terms, in its sole discretion, RankwithJags may remove anyone from the Platform at any time for any reason.
RankwithJags reserves the right to access the user(s)’s account in order to respond to requests for technical support, to maintain the safety and security of the Platform, legal purposes and for other legitimate business purposes, as necessary, in RankwithJags’ discretion.
RankwithJags has no obligation to monitor any content that appears on the Platform or review any conduct occurring through the Platform, including any interactions between Users, however, if RankwithJags receives notice or becomes aware of, any violation of the Platform Terms, then, RankwithJags reserves the right to refuse the user(s) access to the Platform, terminate accounts or remove such violating content at any time without notice to the user(s).

PLATFORM AVAILABILITY

The user(s) access to the Platform may occasionally be suspended or restricted to allow for repairs, maintenance, or due to the introduction of new facilities or services at any time without prior notice. We will attempt to limit the frequency and duration of any such suspension or restriction. The user(s) agrees that RankwithJags will not be liable for any losses that may be incurred by them if for any reason all or part of the Platform is unavailable at any time or for any period for use.

DELETION OF ACCOUNT

As a Learner, the user(s) may delete their account at any time by either writing to us at the email address provided under ‘Contact for User Support/Queries’ section below or by using the delete option provided within the account on the Platform (if available). If the account is deleted (regardless of the reason), the user(s) will no longer have access to their account on the Platform and their Content may no longer be available; any deletion once processed is irrecoverable. RankwithJags is not responsible for the loss of their information and/or Content upon deletion and RankwithJags shall not be liable to any party in any way for the inability to access the Contents arising from any deletion. Please note that all accounts will remain active unless the user(s) explicitly asks us to delete it, and applicable Subscription payments shall continue to be deducted until cancelled by the user(s) or until their account is deleted on their request (as stated in the ‘Pricing and Payments’ section above) or otherwise terminated in accordance with the Platform Terms.

Please note that we may not be able to delete all communications or photos, files, or other documents publicly made available by the user(s) on the Platform, however, we shall anonymize their Personal Information in such a way that they can no longer be identified as an individual in association with such information made available by them on the Platform. We will never disclose aggregated or de-identified information in a manner that could identify the user(s) as an individual.

DISCLAIMER:

THE USER(S) AGREE THAT THE PLATFORM, CONTENT, AND ALL MATERIALS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND THEIR USE OF THE PLATFORM SHALL BE AT THEIR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, ‘RANKWITHJAGS’, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM AND EXCLUDE ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE PLATFORM AND THEIR USE THEREOF. TO THE FULLEST EXTENT PERMITTED BY LAW, ‘RANKWITHJAGS’ EXCLUDES ALL WARRANTIES, CONDITIONS, TERMS OR REPRESENTATIONS ABOUT THE ACCURACY, SECURITY, RELIABILITY, QUALITY, AVAILABILITY OR COMPLETENESS OF THE PLATFORM OR THE CONTENT OF ANY SITES SO LINKED AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF USER-GENERATED CONTENT OR ANY CONTENT ON THE PLATFORM, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM THE USER(S) ACCESS TO AND USE OF THE PLATFORM, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE PLATFORM, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE PLATFORM BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF OF THE USE OF ANY CONTENT THAT IS POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE PLATFORM. AS WITH THE PURCHASE OF A SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, THE USER(S) SHOULD USE THEIR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE.

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ‘RANKWITHJAGS’, ITS AFFILIATES, THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO THE USER(S) FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, LOSSES OR EXPENSES OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF ANY CONTENT AVAILABLE AT ‘RANKWITHJAGS’, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM THE USER(S)’S ACCESS TO AND USE OF OUR ‘RANKWITHJAGS’ PLATFORMS, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE ‘RANKWITHJAGS’ PLATFORM, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR ‘RANKWITHJAGS’ PLATFORMS BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR ANY OTHER CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE ‘RANKWITHJAGS’ PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ‘RANKWITHJAGS’ IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WE UNDERSTAND THAT, IN SOME JURISDICTIONS, WARRANTIES, DISCLAIMERS AND CONDITIONS MAY APPLY THAT CANNOT BE LEGALLY EXCLUDED, IF THAT IS TRUE IN THE USER(S)’S JURISDICTION, THEN TO THE EXTENT PERMITTED BY LAW, ‘RANKWITHJAGS’ AND ITS AFFILIATES LIMIT THEIR LIABILITY FOR ANY CLAIMS UNDER THOSE WARRANTIES OR CONDITIONS TO SUPPLYING THEM THE ‘RANKWITHJAGS’ PLATFORM AGAIN.

THE USER(S) SPECIFICALLY ACKNOWLEDGES THAT ‘RANKWITHJAGS’ SHALL NOT BE LIABLE FOR ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH THE USER(S).

THE ‘RANKWITHJAGS’ PLATFORM IS CONTROLLED AND OFFERED BY ‘RANKWITHJAGS’ AND / OR ITS AFFILIATES DEPENDING UPON THE JURISDICTION. ‘RANKWITHJAGS’ MAKES NO REPRESENTATIONS THAT THE ‘RANKWITHJAGS’ PLATFORM IS APPROPRIATE OR AVAILABLE FOR USE IN OTHER LOCATIONS. THOSE WHO ACCESS OR USE THE ‘RANKWITHJAGS’ PLATFORM FROM OTHER JURISDICTIONS DO SO AT THEIR OWN VOLITION AND ARE RESPONSIBLE FOR COMPLIANCE WITH LOCAL LAW.

INDEMNITY AND RELEASE

To the extent permitted by applicable law, the user(s) agree to defend, indemnify and hold harmless RankwithJags, its affiliates, their respective officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) the use of and access to the RankwithJags Platform; (ii) any violation of any term of the Platform Terms; (iii) any violation of any third party right, including without limitation any copyright, property, or privacy right; (iv) any claim that the User-generated Content caused damage to a third party; or (v) violation of any applicable laws. This defense and indemnification obligation will survive these Terms and Conditions and the use of the RankwithJags Platform.

The user(s) hereby expressly releases RankwithJags, its affiliates and any of their respective officers, directors, employees and agents from any cost, damage, liability or other consequence of any of the actions/inactions of any third-party vendors or service providers and specifically waive any claims or demands that the user(s) may have in this behalf against any of RankwithJags, its affiliates and any of their respective officers, directors, employees and agents under any statute, contract or otherwise.

GENERAL PROVISIONS:

Modification, Amendment or Termination: RankwithJags may, in its sole discretion, modify or revise the Agreement and policies at any time, and the user(s) agrees to be bound by such modifications or revisions. The user(s) continued use of the Platform post any modification of the Agreement shall be taken as their consent and acceptance to such modifications. Nothing in the Agreement shall be deemed to confer any third-party rights or benefits. The user(s) is advised to check our Platform frequently to see recent changes and to keep themselves updated with the most recent updates.
Force Majeure: RankwithJags shall not be liable for failure to perform, or the delay in performance of, any of its obligations if, and to the extent that, such failure or delay is caused by events substantially beyond its control, including but not limited to acts of God, acts of the public enemy or governmental body in its sovereign or contractual capacity, war, terrorism, floods, fire, strikes, epidemics, civil unrest or riots, power outage, and/or unusually severe weather.
Miscellaneous: If any part of the Agreement is found to be unlawful, void or unenforceable, that part of the Agreement will be deemed severable and will not affect the validity and enforceability of any remaining provisions. Any notice required to be given in connection with the Platform shall be in writing and sent to the registered office of RankwithJags. We do not guarantee continuous, uninterrupted or secure access to the Platform, and operation of the Platform may be interfered by numerous factors outside our control. Headings are for reference purpose only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to any breach by the user(s) or others does not waive our right to act with respect to subsequent or similar breaches.
